Welcome to WorkoutMate! These Terms of Use ("Terms") govern your use of the WorkoutMate mobile application ("App") provided by WORKOUT MATE PTY LTD ("Company," "we," "us," or "our"), a company registered in New South Wales, Australia. By downloading, installing, or using the App, you agree to these Terms. If you do not agree with these Terms, you must not use the App.
1. Use of the App
1.1 Eligibility: The App is available to users of all ages, but if you are under the age of 18, you must have the consent of a parent or legal guardian to use the App. By using the App, you represent that you meet this requirement.
1.2 Account Registration: To use certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.
1.3 License: We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
2. User Responsibilities
2.1 Exercise Guidance: The App provides a premade list of exercises with instructions on how to perform them. However, these instructions are general in nature and are not tailored to individual users. You are responsible for ensuring that any exercise is suitable for your physical condition and fitness level. We strongly recommend consulting a qualified fitness professional or healthcare provider before beginning any new exercise program.
2.2 Minors: If you are a parent or legal guardian allowing a minor to use the App, you are responsible for monitoring the minor's use of the App, including ensuring that the minor understands and complies with these Terms.
2.3 Health Disclaimer: You acknowledge that engaging in physical exercise involves inherent risks, including the risk of injury or death. By using the App, you agree that you are voluntarily assuming all risks associated with physical exercise and that the Company is not liable for any injury, illness, or other health issues that may arise from your use of the App.
3. Subscriptions and Payments
3.1 Subscription Plans: WorkoutMate offers subscription plans that provide access to premium features. Subscription fees are charged on a recurring basis, and you agree to pay all applicable fees.
3.2 Cancellation: You may cancel your subscription at any time, but no refunds will be provided for partial subscription periods.
4. Disclaimers
4.1 No Warranties: The App is provided "as is" and "as available" without any warranties of any kind, whether express or implied. We do not warrant that the App will be error-free, secure, or uninterrupted.
4.2 Limitation of Liability: To the maximum extent permitted by law, WORKOUT MATE PTY LTD shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to any injury or health issues resulting from physical exercise.
4.3 Third-Party Content: The App may contain links to third-party websites or content. We do not endorse or assume any responsibility for any such third-party content.
5. Termination
We may terminate or suspend your access to the App at any time, with or without cause, and without prior notice.
6. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.
7. Changes to These Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.
